By visiting or using our website, or make an order for services, you confirm that you are in agreement with and bound by the terms and conditions below.

We are Adviser Webstyle, a small team of Ukraine-based website development experts committed to building and caring for WordPress websites for financial advisers. All web design & development and ongoing services provided by Adviser Webstyle are subject to the following terms and conditions.

1. Definitions

The Client: The company or individual requesting the services of Adviser Webstyle.

Adviser Webstyle: Primary designer & developer.

The Project: Website design & development or other computer-related services being provided to the Client by Adviser Webstyle.

Standard Hourly Rate: The hourly rate advised to the Client by Adviser Webstyle.

2. General

Adviser Webstyle will carry out work only where an agreement is provided either by email or via a messaging app. Adviser Webstyle will carry out work only for clients who are 18 years of age or above.

3. Website Development and Support

Adviser Webstyle retains full ownership of all website files and domains until paid for in full.

Site Development

Your website will be developed in (3) three stages.

• Pre-Development: This stage will be to confirm all your site’s requirements before development starts. You will be required to supply all menu titles, page information, site functionality requests, etc. You will be supplied with a help document to guide you with all information required. A deposit of 1/3 (33%) is required with any project before any design work will be carried out.
• Development: The designer/developer will construct your site on supplied information & requests.
• Revisions: When the designer/developer completes the initial draft of your site, it will be uploaded to a temporary server where the Client can review that site and request changes. It is standard practice to allow up to 3 revisions before extra fees may be applied.

Project Time Scale

• The time scale of a project is generally dictated by the Client. If you have a deadline in mind, we will endeavor to meet it for you. The most common delay in the creation of a site is waiting for content (text/images) to be sent to us by the Client.
• The Client agrees to make available as soon as is reasonably possible to Adviser Webstyle all materials required to complete the site to the agreed standard and within the set deadline.
• Important: Adviser Webstyle will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Changes Made During Development

During the website design and development stage, should the scope of the quoted project change, we may need to come to a compromise to stay on schedule and within budget, or reconsider the deadline and budget to accommodate the new directions in the project.

Compatibility

Adviser Webstyle will endeavor to ensure that any developed site will function correctly on the server it is initially installed in, and that it will function correctly when viewed with all major modern web and mobile browsers.

Please be aware that as new browser versions are developed, they may not be backward compatible. We make reasonable efforts to standardise your site, and we perform cross browser and cross device testing, but there is no way we can account for every single past and future browser or device. Time spent making changes to a website for compatibility due to the introduction of a new browser version will be charged for if required.

Project Completion

• After all work is completed by Adviser Webstyle and approved by the Client, the remaining 2/3 (67%) of the total price must be paid before the site goes live on the Internet or work is handed to the Client.
• 3 Week Grace Period: there is a 21 day period where minor updates can be made (at no charge). These updates include:
  • Minor text changes
  • Spelling errors in text & graphics
  • Link and e-mail linking errors
  • Functionality errors
• Any changes requested that were not a part of the original quote or assigned work may incur the standard hourly rate.
• Any errors found after the grace period that are obvious errors on behalf of Adviser Webstyle will be fixed free of charge. This does not include browser or device updates that may break already tested websites or projects.

Site Updates

After the project is completed and the grace period has ended, Adviser Webstyle performs the following ongoing support to the Client’s website:

• Website Maintenance Service: monthly maintenance plans which include software updates, website security and uptime monitoring, off-site backups, performance optimisation.
• Tech Support and Webmaster Services: additional work for your website on an as-needed, hourly basis.

4. Pricing & Payment Security

Pricing

• All pricing is in Australian Dollars (AUD).
• Adviser Webstyle is not GST registered, therefore all prices mentioned are the total amounts that will be charged.

Deposits

A 1/3 deposit of quote is required for work to start on your project.

Quotations

• Quotations Are Estimations: If your project appears to exceed the estimated value of the sent quote, you will be notified and given a re-estimated value. Common causes for price exceeding original estimation are as follows:
  1. Client wishes to add extra features to project that were not discussed in original estimation
  2. enhancements deemed vital to functionality and professional appearance were added by the developer
  3. third party software or scripting purchases were required to complete site or project
• Time Frame: All quotes are valid for 3 months.

Payment

Adviser Webstyle uses the following payment schedules depending on the type of work you have requested:

• New website builds or large projects (Quoted Work): To commence work on any new website or large project, Adviser Webstyle requires a 1/3 deposit of the quoted amount. After all work is completed by Adviser Webstyle and approved by the Client, the remaining 2/3 of the quoted amount must be paid before the site goes live on the Internet or work is handed to the Client.
• Monthly maintenance plans: The Client pays monthly invoice in the amount specified in the chosen maintenance plan.
• Webmaster Services (additional work done for your website on an hourly basis): Adviser Webstyle charges $50.00/hour, with a 1/4 hour ($12.50) minimum for all charges that are not pre-quoted or contracted. Charges thereafter are billed in 15-minute increments ($12.50).

Payments are due within 14 days of the invoice date.

Methods of Payment

Adviser Webstyle uses Payoneer’s Request a Payment service to initiate a payment request. After we send a payment request, you receive an email from Payoneer with the payment request details and can pay us using one of several supported payment methods.

5. Refund and Cancellation

Refund Policy

Adviser Webstyle provides non-tangible irrevocable goods. Therefore, we do not issue refunds once a proposal or product is provided or hourly-based work is completed or started.

• Please note that if a proposal is accepted and a portion paid (generally 1/3 of the total proposed amount), you are bound by this Refund Policy and agree to and understand its terms and conditions.
• Refunds are not issued for monthly Maintenance Plans if you cancel your account during the billing period.

Any problems or errors with completed jobs that occur after bill payment will be fixed by the designer at no extra cost providing it does not extend outside the original work.

Cancellation

If, for any reason, you’re not happy with the arrangement, you can move your website to wherever and whoever you want. We provide all the files, including the database, to enable you to transfer your website in its entirety (less management and security plugins). Your domains are registered in your name, and a UDAI/EPP number will be provided to you on request.

6. Copyrights, Privacy and Ownership

Copyrights

• Any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the website must be either owned by you, or you must have permission to use them. You own the final graphics and other visual elements that we create for you for this project. You also own text content, photographs and other data you provided, unless someone else owns them.
• Graphic Design: Adviser Webstyle supplies the end product, not the source files (individual elements that make up the design). Copyright and ownership of the source material transfers from Adviser Webstyle to the Client only if there is a specific agreement in writing to this effect.

Design Credit and Portfolio

The Client agrees that Adviser Webstyle may use the work and the Client’s name and identity as part of its portfolio of works for the purposes of promoting and advertising Adviser Webstyle, unless the Client specifically requests otherwise. This includes both a listing on Adviser Webstyle’s website and in the footer of the Client’s website.

Privacy Policy

Passwords and private information you give me will be treated with strict confidentiality. No personal information that you provide to me will be shared with any third party.
